Matej Juhár · withdrawal from the contract and consumer rights (General Terms and Conditions, Article XII) · effective from 28 October 2026
A consumer may withdraw from a distance contract within 14 days of its conclusion without giving any reason; this page describes the procedure and consequences (GTC, Article XII).
I. The right to withdraw: who is entitled to it and within what timeframe
1. The right to withdraw from the contract lies with the consumer who has concluded a contract with the provider (Matej Juhár, Company Registration Number: 14120003, Radlická 112/22, 150 00 Prague – Smíchov) remotely (by email, via a form, or by telephone) or outside the provider’s business premises. A business does not have this right.
2. Withdrawal is possible without giving any reason within 14 days of concluding the contract (Section 1829(1) of the Civil Code).
3. The time limit is deemed to have been met if the notice of withdrawal is sent no later than the last day of the time limit.
II. How to withdraw from the contract
1. Send your notice of withdrawal:
- by email to mato@matejjuhar.com,
- by post to the address: Matej Juhár, Radlická 112/22, 150 00 Prague – Smíchov.
2. You may use the model form in the annex, but this is not mandatory. A clear statement that you are withdrawing from the contract is sufficient.
3. If a ‘Withdraw from the contract’ button is available on the website, you may also withdraw via that button. The provider will confirm receipt of the withdrawal without undue delay by email, stating the content of the notice and the date and time it was sent (General Terms and Conditions, Article XII(2)).
4. Keep a record of the dispatch of the notice; this serves as proof that the time limit has been met.
III. Service commenced during the withdrawal period, pro rata payment and termination of rights
1. If the consumer expressly requests that the provision of the service commence before the expiry of the withdrawal period, they shall pay a proportionate part of the price for the performance provided up to the point of withdrawal.
2. If, with the consumer’s prior express consent, the service is fully performed before the expiry of the withdrawal period and the provider informed the consumer of this before the conclusion of the contract, the right of withdrawal ceases to apply (Section 1837 of the Civil Code).
3. When placing an order, the consumer shall expressly confirm that they request the service to commence before the expiry of the withdrawal period and that they have been informed of the consequences (pro rata payment, possible expiry of the right to withdraw). The provider shall retain a record of the consent and of the delivery of the information, including the date and time, in the ordering system.
4. The proportionate part of the price is determined according to the ratio of the parts of the service actually performed and delivered (pre-production, production, editing, delivered stages) to the total scope agreed in the contract. The provider shall set this off against any refunded payments and shall refund only the difference to the consumer (GTC, Article XII(5)).
Illustrative example (not a price list): contract price 30,000 Kč, advance payment 15,000 Kč. Prior to withdrawal, pre-production and production had been carried out, accounting for 40% of the contract scope. The proportionate amount is 12,000 Kč; the consumer will be refunded 3,000 Kč.
IV. Refunds
1. The provider shall refund all payments to the consumer (except for the proportionate amount under Article III) without undue delay, no later than 14 days from receipt of the notice of withdrawal, using the same method by which the consumer made the payment, unless otherwise agreed. The consumer shall not be charged a fee for the refund.
2. Method of refund depending on the payment method:
| Method of payment | Refund |
|---|---|
| Bank transfer | to the bank account from which the payment was made |
| Payment card (Stripe) | to the payment card used for the payment |
| Cryptocurrency (CoinGate) | the amount in CZK stated on the invoice; the method of refund (bank account or crypto address) shall be agreed with the consumer## |
V. Cancellation and defects; exceptions to the right of withdrawal
1. Withdrawal under this document and cancellation of an order by way of compensation pursuant to Article VII of the GTC are not compatible. If the consumer withdraws within the 14-day period, the compensation fee under Article VII of the GTC does not apply; only a pro rata payment under Article III(4) applies. The same applies to consultations (GTC, Article XIV(10)).
2. After the expiry of the 14-day period, an order may be cancelled in accordance with Article VII of the GTC; in the case of consultations, in accordance with Article XIV of the GTC.
3. Rights arising from defective performance are not affected by withdrawal; they are exercised in accordance with the Complaints Procedure (GTC, Article VIII).
4. The right to withdraw from the contract is excluded only in the cases set out in Section 1837 of the Civil Code. In the case of services, this applies in particular to services performed in full in accordance with Article III(2). The provider shall inform the consumer of such a case prior to the conclusion of the contract.
5. The consumer may resolve a dispute out of court through the Czech Trade Inspection Authority (ČOI), Štěpánská 567/15, 120 00 Prague 2, www.coi.cz. The right to bring the matter before a court remains unaffected (GTC, Article XIII).
